So. of 57th Hours: Mon-Sat Sun Kellin Petition A petition drive requesting a grand jury investigation of the death of Richard Kellin may fall short of the total signatures needed, Douglas County Election Commissioner Steve Wiitala said Friday. Seventy-three percent of the 6,107 signatures counted were from registered voters in Douglas County, Wiitala said. At that rate the drive would fall 380 signatures short of the 13,299 needed.

Kellin was injured May 5 while in police custody. He died of those injuries May 9. Wiitala's office will have 30 days to validate petitions. Douglas County District Judge Lawrence Corrigan will then have 15 days to decide whether the petitions satisfy state requirements for calling a grand jury. "The outlook is for a continuation of relatively slow growth. The growth in the economy will offset marginally the decline in individual income tax receipts due to the federal changes," said Wade German of Omaha, a member of the Economic Forecasting Advisory Board. The board met Thursday at the Capitol. Nebraska's agricultural sector continues to suffer, but the state as a whole can expect some slight economic growth through the 1988-89 fiscal year, said German, a former University of Nebraska at Omaha economist. Richard Jones 2755 Wyoming was found unconscious by his mother about 3:45 p.m. Wednesday, police said. A rescue squad took him to Immanuel Hospital, where he was pronounced dead an hour later, police said. Police Sgt. John Lehotyak said the death is being considered an accident.

He said evidence indicates Jones was working on a pickup truck in closed garage and may have started the truck several times, causing fumes to fill the garage. Bruce Babbitt, a Democratic presidential candidate, said Friday in Omaha that the Iowa caucuses and New Hampshire primary give serious candidates a chance for the nomination by guaranteeing "a wide-open process." In Iowa and New Hampshire, candidates are limited to spending no more than $1 million, which aids competition, Babbitt said. But because candidates from New Ethical Questions, easier, Spire told his audience in the Witherspoon Concert Hall of Joslyn Art Museum. He said legal and medical professionals should not be the only people providing answers. "If we don't have enough confidence to seek out public input," Spire said, "then we don't have confidence in our democratic system." the questions that will need answers, Spire said, are: -Does society invest in artificial hearts to save an older person, or in preventive medicine to keep a young person well? -Does society spend $300,000 for an artificial heart, or $300,000 for inoculations in Harlem? Spire said that when trying to answer such questions, society must look at the historical, religious and philosophical views of those involved. "These views need to be respected," he said, "and conflicting views must be respected." Ex-Omahan Killed In Missouri Accident Funeral services are pending for former Omahan D.S.

Court Approves Child Testimony Against Father Lincoln (AP) A lower court acted properly when it allowed children to testify in a parental rights case about sexual abuse they suffered from their father, the Nebraska Supreme Court said Friday. In a unanimous decision, the high court upheld a 1985 ruling by the Separate Juvenile Court of Douglas County that terminated the parental rights to three children of a man referred to as L.H.W. The father objected to the trial court's decision to permit the testimony of the children. Besides his three children, also testifying boy who was not his son.

That boy was a half-brother to the other children, sharing the same mother. The mother's parental rights to those four children and a younger girl, who also was determined to be the daughter of L.H.W., were terminated by the Juvenile Court. She did not appeal. The four older children, ages 10, 9, 6 and 5 at the trial, were questioned by the judge before they were allowed to testify to determine their ability to answer simple questions and to distinguish between the truth and a lie. The father argued that their testimony should have been thrown out because it was incompetent and inconsistent.

The father also argued unsuccessfully that the testimony of police officers and social workers was hearsay and that the state failed to meet its burden of proof by clear and convincing evidence. "The record in this case leads us to the conclusion that the evidence clearly and convincingly establishes that there was sexual and physical abuse of the four older children by the appellant (father), and conduct by the appellant which was seriously detrimental to the health, morals and well-being of all the children," said Judge John Grant, who wrote the ruling. The Supreme Court reversed the lower court's decision to terminate the father's parental rights to the youngest child. The high court returned that part of the case to the lower court for further proceedings. In other decisions, the Supreme Court: -Affirmed a Douglas County District Court decision that upheld the conviction of Kevin C.

Polyascko for taking indecent liberties with a child. He was sentenced to 60 days in jail and fined $300. -Affirmed a decision by the Separate Juvenile Court of Lancaster County that terminated the parental rights of a father, referred to as P.S., to three children. -Affirmed a Lancaster County District Court conviction of Michael P.
